Terms & Conditions

These terms govern the use of Chedi Legal's services. Please read them at your own pace. If anything is unclear, we welcome your questions before you proceed.

1. Definitions

Throughout these Terms & Conditions, the following terms carry the meanings set out below:

  • "Agreement" — these Terms & Conditions, together with any engagement letter or service agreement signed by both parties.
  • "We," "Us," "Our" — Chedi Legal, registered and operating at 53 Thanon Ratchadamnoen, Mueang, Nakhon Ratchasima 30000, Thailand.
  • "Client" / "You" / "User" — any individual or entity who accesses this website or engages Chedi Legal for services.
  • "Services" — the pension advisory and representation services described on this website and in any engagement documentation.
  • "Content" — all text, documents, advice, written summaries, reports, and materials produced or shared by Chedi Legal in the course of providing Services.
  • "Website" — the Chedi Legal website accessible at this domain and all associated pages.
  • "Personal Data" — any information relating to an identified or identifiable natural person, as defined under Thailand's Personal Data Protection Act B.E. 2562 (PDPA).

2. Acceptance of Terms

By accessing our website or engaging our services, you indicate that you have read and understood these Terms and agree to be bound by them. If you do not agree, please do not use the website or request services.

  • You must be at least 18 years of age to engage Chedi Legal's services.
  • You confirm that you have the legal capacity to enter into this Agreement on your own behalf, or on behalf of an organisation if applicable.
  • Where you act on behalf of another person or entity, you represent that you are duly authorised to bind them to these Terms.

3. Service Description

Chedi Legal provides advisory and representational services relating to pension matters in Thailand. Our services are offered in three tiers, each with a defined scope:

Pension Standing Review — ฿4,350

A measured review of your pension status, conducted over one meeting spanning approximately two weeks. Includes a written summary for your records.

Pension Issue Handling — ฿9,500

Management of a specific pension issue with the relevant fund, including preparation, submission, and follow-up correspondence. Typical duration: one to two months.

Comprehensive Pension Case — ฿16,700

Full representation for complex pension disputes, handled through to conclusion. Includes complete file management and a closing report.

Services are provided primarily in Nakhon Ratchasima and surrounds, with remote correspondence available for appropriate matters. We reserve the right to decline any engagement that falls outside our scope or expertise.

4. User Responsibilities

To allow us to serve you properly, you agree to:

  • Provide accurate, complete, and timely information as requested during the engagement.
  • Notify us promptly of any changes to your circumstances that may affect the matter we are handling.
  • Keep appointment times and respond to our correspondence within a reasonable period.
  • Use this website and any materials provided for lawful purposes only.
  • Respect the confidentiality of any documents or advice provided to you.

The following activities are not permitted:

  • Submitting false, misleading, or fabricated documentation to us or on our behalf to any third party.
  • Using our services to facilitate any unlawful purpose.
  • Attempting to gain unauthorised access to any part of our systems or communications.
  • Reproducing or redistributing advice or Content we provide without our prior written consent.
  • Using our website in any manner that could damage or impair its performance or availability.

5. Intellectual Property

All content on this website — including text, design, logos, and written materials — is the property of Chedi Legal or used with appropriate authorisation. No part may be reproduced, distributed, or used commercially without our prior written consent.

Written summaries, reports, and advice prepared for you are provided for your personal use in relation to your pension matter. You may not share them with third parties or use them for any purpose beyond your own matter without our written agreement.

We grant you a limited, non-exclusive, non-transferable licence to access and use this website for lawful personal purposes. This licence may be withdrawn at any time if these Terms are breached.

6. Payment Terms

  • Currency: All fees are quoted and payable in Thai Baht (฿).
  • Fee Agreement: Fees are confirmed in writing before work commences. No work begins until fee terms are agreed.
  • Payment Methods: Accepted payment methods will be communicated at the time of engagement. Receipts are provided for all payments.
  • Invoicing: Invoices are issued at the start or upon agreed milestones of each engagement, as specified in the engagement letter.
  • Refunds: Where work has not yet commenced following full payment, a refund may be requested within 7 days. Once work has commenced, fees are not refundable for the portion of work completed. If a matter cannot proceed due to our inability to act, we will refund any uncommenced portion fairly and promptly.
  • Late Payment: We reserve the right to pause or withdraw services where payment is materially overdue, following reasonable notice to you.

7. Service-Specific Terms

In addition to the general terms above, the following apply to all service engagements:

  • Scope: Each engagement begins with a written scope of work. Work beyond that scope requires a separate written agreement.
  • Timelines: Estimated timescales are provided in good faith. Delays caused by third parties — including pension funds, government bodies, or the client — do not constitute a breach on our part.
  • Confidentiality: We hold all client information in strict confidence. We do not share your details with any third party except as necessary to carry out your matter, or as required by Thai law.
  • Changes to Scope: If the nature of a matter changes materially after engagement begins, we will discuss and agree any adjustment to fees or timeline with you before proceeding.
  • Outcome: We act with care and diligence on your behalf. We do not represent that any particular outcome will be achieved, as results depend on facts, fund policies, and applicable law that are beyond our control.

8. Disclaimers

Information on this website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such without a formal engagement.

The website and its content are provided on an "as available" basis. We take reasonable care to keep information current and accurate but do not warrant that all content is complete, error-free, or suitable for any particular purpose.

No specific result is represented or implied by the use of our services. Each matter is unique, and outcomes depend on individual circumstances, the conduct of third parties, and applicable law.

9. Limitation of Liability

To the extent permitted by Thai law, Chedi Legal's total liability arising from any engagement shall not exceed the fees paid for the specific service from which the claim arises.

We are not liable for any indirect, incidental, or consequential loss arising from the use of this website or from services rendered, including loss of pension entitlement caused by third-party decisions outside our control.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable Thai law.

Force Majeure: We are not liable for delays or failure to perform where caused by circumstances beyond our reasonable control, including natural events, regulatory changes, or third-party system failures.

10. Indemnification

You agree to indemnify and hold Chedi Legal, its staff, and associated advisors harmless from any claim, loss, or expense (including reasonable legal fees) arising from:

  • Your breach of these Terms;
  • False or misleading information provided by you in connection with an engagement;
  • Your use of the website in a manner that violates applicable law.

11. Termination

Either party may end an engagement by providing written notice. On termination:

  • Fees for work completed up to the date of termination remain payable.
  • We will return or securely dispose of your documents as directed, within a reasonable time.
  • Any outstanding amounts owed by either party survive termination.

We reserve the right to terminate an engagement without notice if you have provided materially false information, acted in breach of these Terms, or if continuing the matter would place us in a professional conflict of interest.

Clauses 5, 8, 9, 10, and 12 of these Terms survive termination of any engagement.

12. Dispute Resolution

These Terms are governed by the laws of Thailand. Any dispute arising under this Agreement is subject to the jurisdiction of the courts of Nakhon Ratchasima Province, Thailand.

Informal Resolution: Before commencing formal proceedings, both parties agree to attempt resolution in good faith through direct communication. Please contact us at [email protected] to raise any concern.

Where direct resolution is not achieved within 30 days, either party may refer the matter to mediation through a mutually agreed mediator in Thailand before seeking court intervention, unless urgent relief is required.

13. General Provisions

  • Entire Agreement: These Terms, together with any signed engagement letter, constitute the full agreement between the parties and supersede any prior understandings.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure to enforce any provision at any time does not waive the right to enforce it in the future.
  • Assignment: You may not assign any rights or obligations under this Agreement without our prior written consent. We may assign our obligations to another qualified professional with notice to you.
  • Notices: Formal notices under this Agreement should be sent to [email protected] or by post to 53 Thanon Ratchadamnoen, Mueang, Nakhon Ratchasima 30000, Thailand.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. We will post an updated version on this page with a revised "Last Updated" date.

If you have an ongoing engagement when a material change is made, we will notify you directly. Continued use of our services after notice of changes constitutes acceptance of the revised Terms.
